1. Agreement to Terms

By accessing or using the biddable website at getbiddable.com and our lead generation services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

biddable provides autonomous lead generation services for businesses. We create and manage advertising campaigns across various platforms to generate leads on your behalf. Leads are delivered exclusively to your business and are not shared with competitors in your service area.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. Account Registration

To use certain features of our Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Pricing and Payment

• Our Services are offered on a monthly budget model. You set a monthly spending amount and we book appointments at a fixed price per appointment that varies by industry.
• There are no long-term contracts, subscriptions, or minimum commitments. You may cancel at any time.
• Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service.
• All fees are quoted in US dollars. Unused monthly balance rolls over and is not forfeited.
• We reserve the right to modify our pricing at any time. Changes will not affect your current billing cycle.

6. Appointment Delivery

• We aim to deliver appointments within the timeframe communicated during onboarding, but delivery times may vary based on your market, industry, and budget.
• Appointments are delivered exclusively to your business and are not shared with other businesses in your area.
• A "booked appointment" is defined as a verified contact (name, phone number, and/or email) of a prospective customer who has agreed to a specific date and time with your business.
• It is the contractor's responsibility to confirm the appointment with the customer prior to the scheduled time. biddable is not responsible for no-shows that result from a failure to confirm.
• While we strive to deliver high-quality appointments, we cannot guarantee conversion. Results depend on factors outside our control including your response time, service quality, and pricing.

7. Refund Policy

• Refund requests for invalid appointments must be submitted within 48 hours of receiving the appointment information. Requests submitted after this window will not be honored.
• An appointment may be considered invalid if the contact information is incorrect, the prospective customer did not agree to a booking, or the appointment is a duplicate of one previously delivered.
• To request a refund for an invalid appointment, contact us at ops@getbiddable.com with your account details and the reason for the dispute.
• New clients are covered by a 30-day satisfaction guarantee. If we do not book any valid appointments in your first 30 days, we will refund your remaining balance in full.

8. Your Responsibilities

As a user of our Services, you agree to:

• Provide accurate and up-to-date business information
• Respond to leads promptly and professionally
• Comply with all applicable laws and regulations in your industry and location
• Not use our Services for any unlawful, fraudulent, or harmful purposes
• Not attempt to reverse-engineer, copy, or replicate our advertising strategies or systems
• Maintain any necessary business licenses and insurance required in your jurisdiction

9. Intellectual Property

All content, features, and functionality on the biddable website, including but not limited to text, graphics, logos, icons, images, and software, are the property of biddable and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, error-free, or that any results (including lead volume or conversion rates) will meet your expectations. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, biddable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our Services. Our total liability for any claim related to our Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless biddable and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

13. Cancellation & Termination

• There are no contracts or minimum commitments. You may cancel your service at any time.
• To cancel, send a cancellation request to ops@getbiddable.com. Cancellations will be confirmed and honored within 24 hours of your request.
• We reserve the right to suspend or terminate your access to our Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
• Upon cancellation or termination, any unused balance in your account may be refunded at our discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New York, New York.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
